Short Description of Activity

This was an unusual webinar on trails because it was not allowed to be recorded. The presenter is a consultant in litigations that represents either defendants or complainants during litigation, so what he had to say could not be spread to the general public because it might impact past or future lawsuits. He discussed how to examine accident and incident scenes to see if the defendant was negligent or if the trail was constructed in a hazardous way, and how well the trail markers informed users about difficulty, etc. He also discussed cases where the complainant was negligent or just “in over his/her head”, and how that would impact the litigation.

Reflection/Evaluation

This was an excellent workshop, and gave me information that confirmed certain issues of neglect, etc. that was involved in a recent wrongful death lawsuit for my own family. I wish that there were certain definitional slides that were available, because it would help with trail construction and repair for some of the different collaboratives, of which I am a member. It s scary just how easy it is to make hazardous mistakes in trail construction, maintenance, and signage. It makes me hesitant to be involved in any way with those projects.
